1. Introduction & Legal Nature of Service

Soar Funding (the "Company", "we", "us", "our") operates an online proprietary trading evaluation platform accessible at https://soar-funding.com (the "Platform").

The Platform provides simulated trading challenges only, designed to evaluate trading performance in a demo environment. No real trading is conducted on behalf of users, and no customer funds are ever placed at market risk.

Nothing on the Platform constitutes investment advice, financial advice, portfolio management, brokerage services, or an offer to trade real capital.

By purchasing, accessing, or using any service on the Platform, you enter into a legally binding agreement with the Company (the "Agreement").

2. Company Details

The Platform is owned and operated by SOAR SOFTWARE LTD, a company incorporated in England & Wales (Company No. 16435138), with its registered office at 86–90 Paul Street, London, EC2A 4NE.

3. Eligibility & Jurisdiction

You confirm that: - You are 18 years of age or older; - You have full legal capacity to enter into binding contracts; - You are not a resident, citizen of, or located in any jurisdiction subject to UK, EU, UN, or OFAC sanctions; - You are solely responsible for ensuring your participation complies with the laws of your jurisdiction.

The Company makes no representation that the Platform is lawful or accessible in all jurisdictions.

4. Nature of the Services

All accounts are simulated demo accounts;

All balances, profits, losses, and performance metrics are virtual;

Fees paid are service fees for evaluation access only;

Passing a challenge does not guarantee a payout or continued access.

The Company may, at its discretion, internally mirror or hedge simulated trades for risk management purposes. This does not create any entitlement or relationship with the user.

5. Account Registration & Responsibility

You must provide accurate and complete information at registration.

You are responsible for: - Safeguarding login credentials; - All activity conducted on your account; - Ensuring your device, connection, and setup are suitable.

The Company is not responsible for losses or breaches caused by user-side technical issues.

6. Payments, Fees & No-Refund Policy

All purchases are final and strictly non-refundable, including but not limited to: - Failed or breached accounts; - Rule misunderstandings; - Platform downtime or technical issues; - Inactivity; - Discretionary decisions; - BNPL activation fees not paid.

Refunds are issued only where required by law.

Any chargeback, dispute, or payment reversal will result in: - Immediate account termination; - Loss of all profits and eligibility; - Permanent ban from the Platform.

7. Challenge Types & Structures

7.1 Standard 2-Step Challenge

Phase 1 - Profit Target: 8% - Maximum Loss: 8% (fixed) - Daily Loss Limit: 4% (fixed) based on EOD equity or balance (whichever is higher)

Phase 2 - Profit Target: 6% - Maximum Loss: 8% (fixed) - Daily Loss Limit: 4% (fixed) based on EOD equity or balance (whichever is higher)

7.2 Standard 1-Step Challenge

Profit Target: 10%

Maximum Loss: 8% (trailing)

Daily Loss Limit: 3% (fixed) based on EOD equity or balance (whichever is higher)

8. Funded Stage – Standard Challenges

First payout available after 30 calendar days;

First payout profit split: 100%;

Ongoing payouts: 80% bi-weekly;

Minimum payout request threshold: 1% profit.

Consistency Rule (Funded Stage Only)

1-Step: Max 35% of total profits in one trading day;

2-Step: Max 40% of total profits in one trading day.

9. Buy Now Pay Later (BNPL) Challenges

9.1 2-Step BNPL – Challenge Phase

Phase 1 Target: 8%

Phase 2 Target: 5%

Maximum Loss: 10% (trailing)

Daily Loss Limit: 5% (fixed)

Inactivity Rule: 30 days

Activation fee must be paid within 15 days of passing

9.2 2-Step BNPL – Funded Phase

Maximum Loss: 8% (trailing)

Daily Loss Limit: 3% (fixed)

Profit Split: 80%

Payouts: After 30 days, then bi-weekly

Consistency Rule: 25% of total profits in one trading day

Inactivity Rule: 30 days

9.3 1-Step BNPL – Challenge Phase

Profit Target: 6%

Maximum Loss: 10% (trailing)

Daily Loss Limit: 5% (fixed)

Inactivity Rule: 30 days

Activation fee due within 15 days of passing

9.4 1-Step BNPL – Funded Phase

Maximum Loss: 6% (trailing)

Daily Loss Limit: 3% (fixed)

Profit Split: 80%

Payouts: After 30 days, then bi-weekly

Consistency Rule: 15% of total profits in one trading day

Inactivity Rule: 30 days

Add-ons selected at original purchase carry forward and cannot be changed. Add-ons may increase activation fees.

10. Rapid Runway Challenge

Phase 1: Skipped

Phase 2 Target: 5%

Maximum Loss: 8% (trailing)

Daily Loss Limit:

Challenge: 5%

Funded: 3% (fixed)

Profit Split: 80% bi-weekly

Consistency Rule (Funded): 20% of total profits in one trading day

Inactivity Rule: 30 days

Activation fee due within 15 days of passing

11. Trading Rules (All Accounts)

❌ No copy trading or hedging across accounts

❌ No HFT, toxic trading, execution abuse, or latency arbitrage

❌ No news trading unless add-on is purchased (soft breach)

✅ Weekend holding permitted

✅ VPNs and static IPs allowed if consistent

⏱ Minimum 2-minute hold required (soft breach)

📉 No trading within 5 minutes before/after high-impact news without add-on (profits may be deducted)

🕒 Inactivity: At least one trade every 30 days

🤖 EAs must be reviewed and approved

🛑 Stop-loss not mandatory but recommended

All trades are monitored by the risk team.

12. Toxic Trading & Discretion

"Toxic trading" includes, but is not limited to, strategies or behaviour that exploit demo conditions, pricing, execution, latency, or platform infrastructure.

The Company retains absolute discretion to determine whether any strategy is toxic, abusive, or unsuitable.

This determination: - Requires no warning; - Requires no explanation; - Is final and binding; - Is not subject to appeal.

13. Soft Breaches & Hard Breaches

Soft Breaches

Soft breaches accumulate and do not reset until a successful payout is completed.

The Company is not required to notify traders of soft breaches.

Escalation

Three (3) soft breaches = one (1) hard breach;

Detection and enforcement may occur retrospectively;

Enforcement is not required to be immediate or automated.

Hard Breaches

Hard breaches result in: - Immediate termination; - Loss of all profits; - No payout eligibility; - No refund.

14. Reviews, Profit Adjustments & Retrospective Action

The Company may: - Review accounts after phase completion or payout request; - Deduct profits; - Reclassify breaches; - Terminate accounts based on historical activity.

Profits earned prior to breach detection are not protected.

15. Payout Conditions & Employer of Record

To receive payouts, traders must: - Complete full KYC; - Provide proof of payout account ownership; - Sign a Funded Trader Agreement; - Contract with an approved Employer of Record; - Assume full tax responsibility.

Third-party payouts are prohibited.

16. Intellectual Property & Data Use

All systems, data, rules, and content belong to the Company.

We may record, analyse, store, and use anonymised trading data for operational, analytical, or marketing purposes.

17. Limitation of Liability

To the fullest extent permitted by law, the Company's liability is limited to fees paid.

We are not liable for: - Lost profits; - Data loss; - Business interruption; - Indirect or consequential damages.

18. Indemnity

You agree to indemnify the Company against all claims, losses, damages, and costs arising from your use of the Platform or breach of these Terms.

19. Amendments

We may update these Terms at any time. Continued use constitutes acceptance.

20. Termination

The Company may terminate accounts at any time, without notice or refund, for rule violations or risk concerns.

21. Governing Law & Dispute Resolution

These Terms are governed by the laws of England & Wales.

Disputes will be resolved via: - Informal negotiation (30 days), then - Binding arbitration in London under LCIA rules.

Class actions are waived.

22. Entire Agreement & Severability

These Terms constitute the entire agreement. Invalid provisions do not affect the remainder.
