1. Introducción

Soar Funding, disponible en https://soar-funding.com (la "Plataforma"), proporciona un entorno de trading simulado con fines educativos.

La Plataforma es propiedad y está operada por SOAR SOFTWARE LTD, una empresa constituida bajo las leyes de Inglaterra y Gales con número de empresa 16435138, y domicilio registrado en 86-90 Paul Street, Londres, EC2A 4NE.

Al acceder o utilizar la Plataforma, usted acepta estar sujeto a estos Términos y Condiciones (el "Contrato"), que rigen su relación con la Empresa.

2. Elegibilidad

  • Debe tener al menos 18 años de edad y ser legalmente capaz de celebrar contratos vinculantes.
  • No puede utilizar la Plataforma si es residente de cualquier país incluido en las listas de sanciones de la ONU, UE, u OFAC.
  • Es su única responsabilidad asegurar que su uso de la Plataforma cumpla con las leyes de su jurisdicción.

3. Servicios

La Empresa ofrece Cuentas de Trading Demo simuladas que replican condiciones reales de mercado únicamente con fines educativos y de evaluación:

  • Los desafíos de trading ("Desafíos") no involucran transacciones financieras reales.
  • Todas las operaciones se realizan utilizando fondos virtuales.
  • No se realizarán pagos monetarios reales a menos que se indique explícitamente lo contrario.
  • Cada Desafío puede tener reglas específicas, tarifas y criterios de elegibilidad, que se divulgan en la Plataforma. El objetivo es identificar traders hábiles, no proporcionar asesoramiento de inversión o educación financiera.

4. Funded Accounts

4.1 Eligibility

After passing the 1-step or 2-step Challenge, you may become eligible to continue in a Funded Stage account, subject to the Company's terms and compliance requirements.

4.2 Verification Requirements

You must provide:

  • Proof of identity
  • Proof of residential address
  • Source of funds documentation
  • You may also be subject to sanctions checks.

4.3 Simulated Environment

  • All Funded Stage activity takes place in a simulated trading environment.
  • The Company may, at its discretion, mirror or hedge your simulated trades in a real environment via its corporate accounts.

4.4 Use of Funds

Any fees paid are treated as service fees and are not used for trading purposes.

5. Account Registration and Use

  • To register, you must provide accurate personal information and demonstrate financial trading proficiency.
  • You are responsible for safeguarding your login credentials and ensuring that your account is not accessed or used by others.
  • The Company is not liable for any issues arising from your internet connection or device setup.

6. Terms of Payment

  • Fees apply only to Challenge participation and related add-ons.
  • Upon payment, you will receive an electronic invoice. Fees are non-refundable except where stated otherwise.

7. User Portal Access

Once registered, you may access your user portal to:

  • View and manage account settings
  • Monitor trading performance
  • Access available learning tools

8. Service Availability

  • While the Company strives for consistent Platform availability, access may be suspended or interrupted due to maintenance or circumstances beyond our control.
  • We implement strong data protection measures, but we cannot guarantee absolute protection from breaches or data loss.

9. Data Protection

  • The Company complies with applicable data protection laws, including the UK Data Protection Act (2018) and EU GDPR.

10. Restricted Activities

You may not:

  • Violate these Terms or any applicable law
  • Infringe intellectual property rights
  • Submit false or misleading information
  • Engage in fraudulent or manipulative trading practices
  • Use bots, scripts, or automation to manipulate results
  • Impersonate any person or entity or misrepresent your affiliation
  • Share, sell, or lease access to your account or login credentials
  • Abuse or exploit any errors, delays, or inconsistencies in Platform pricing, execution, or infrastructure for personal gain

11. Authority to Cancel or Suspend Trades

The Company reserves the right to:

  • Cancel or adjust trades due to technical errors, manipulation, or rule breaches
  • Withhold or adjust account balances resulting from errors, unauthorised actions, or evaluation term violations
  • Restrict or limit trading activity in response to abnormal market conditions, risk exposure, or suspected abuse
  • Investigate and act upon suspected fraudulent activity, including collusion or the use of prohibited strategies

12. Modifications and Amendments

  • We may update these Terms without prior notice.
  • Changes take effect immediately once published. Continued use of the Platform signifies your acceptance of such changes.

13. Intellectual Property Rights

  • All content, systems, and trademarks on the Platform belong to the Company or its licensors.
  • You are granted a limited, non-transferable license to use the Platform solely for Challenge participation. Any unauthorised reproduction or distribution is prohibited.

14. Trade Data Access and Utilisation

We may access your trade data to:

  • Monitor compliance
  • Provide feedback
  • Improve Platform functionality
  • Anonymised data may be used for analytical or research purposes.

15. Disclaimers of Warranties

The Platform is provided "as is" and "as available."

We make no warranties regarding:

  • Accuracy of market data
  • System uptime
  • Trading outcomes

16. Indemnification

You agree to indemnify and hold harmless the Company from all claims, damages, liabilities, and expenses arising from:

  • Your use of the Platform
  • Any breach of these Terms
  • Any misuse or circumvention of Platform services

17. Limitation of Liability

  • Our liability is limited to the total fees paid by you.
  • We are not liable for:
    • Lost profits
    • Data loss
    • Business interruptions
    • Any indirect, incidental, or consequential damages

18. Notice and Communication

Notices and communications may be sent via:

  • Email
  • The Platform
  • Contact details provided during registration

19. Duration and Termination

This Contract begins upon your registration and continues until:

  • Completion of your Challenge, or
  • Termination by either party in line with these Terms

Accounts may be terminated without notice in cases of fraud, abuse, or violation of rules.

20. Governing Law

These Terms are governed by the laws of England and Wales.

21. Confidentiality

You agree to maintain the confidentiality of all non-public information shared by the Company, unless legally required to disclose it.

22. Force Majeure

We are not liable for delays or failure caused by events outside our control, including:

  • Natural disasters
  • Cyberattacks
  • Network outages
  • Governmental restrictions

23. Assignment and Other Dealings

  • You may not assign your rights under this Contract without consent.
  • We may assign our rights in cases of corporate change, restructuring, or sale.

24. Entire Agreement

These Terms represent the entire agreement between you and the Company.

25. Severance

If any provision is deemed unenforceable, the rest remain in effect.

26. Payouts and Challenge Rules

Challenge Types

1-Step Challenge

  • Profit target: 10% (based on High Water Mark of account equity)
  • Daily loss limit: 3% fixed on equity
  • Maximum loss: 8% fixed on equity

2-Step Challenge

  • Phase 1 profit target: 8% equity HWM
  • Phase 2 profit target: 6% equity HWM
  • Daily loss limit: 4% fixed on equity
  • Maximum loss: 8% fixed on equity

Note: Loss limits apply individually to both the Challenge account and the Funded Stage account.

General Rules

  • Payouts are processed every two weeks
  • First payout: after 30 calendar days, with a 100% profit share
  • Ongoing payouts: every two weeks, at an 80% profit share
  • Minimum of 1% profit required to request a payout
  • Maximum funded allocation per person: $300,000
  • Copy trading is prohibited
  • Trades must be held for at least 2 minutes
  • No trading allowed within 5 minutes before or after high-impact news events, unless a news add-on has been purchased
  • Consistency Rule: No single trading day may account for more than 40% of total profits
  • Hedging across accounts is not permitted

Add-Ons

Optional add-ons may be purchased to:

  • Enable news trading
  • Unlock improved payout terms
  • Adjust or remove certain limitations

Add-ons must be explicitly approved via the Platform.

Employer of Record & Funded Contract

To receive payouts, Funded Traders must:

  • Contract with an approved Employer of Record (e.g., Riseworks.io)
  • Complete full KYC verification
  • Sign the Funded Trader Agreement

KYC Documentation

To request a payout, you must submit:

  • A valid passport or national ID
  • Proof of address (bank statement or utility bill)
  • Proof of payout account ownership (must match the trader's name)

Third-party payouts are strictly prohibited.

27. Dispute Resolution

  • If any dispute arises out of this Contract, both parties agree to resolve it through informal negotiation.
  • If unresolved after 30 days, the dispute will be referred to binding arbitration in London, under the rules of the LCIA (London Court of International Arbitration).
